Obligations of the Policyholder

  1. You are advised to go through the Policy Schedule cum Certificate of Insurance which is issued based on information and declaration provided by you.
  2. Transcript of Information & Declaration is also provided to enable you to go through the same again and if any error/ discrepancy is found in respect of vehicle details, No Claim Bonus or any other information provided by you, it should be brought to our notice within 15 days of receipt of this policy for necessary correction along with the supporting documents, otherwise it will be deemed to be correct.
  3. Please note that any fraud will lead to cancellation of Policy ab initio with non-consideration of claim, if any.
  4. Further, non-disclosure of material facts may impact the claim settlement. Material facts include vehicle details such as Class of Vehicle, Cubic Capacity, Make, Model, Variant

To protect against such unpleasant situations you need a Insurance policy which covers the car against the losses caused due to fire, theft, explosions, burglary, riots, strikes, earthquake, flood, cyclones, accidental external means, malicious acts and terrorist activities.

Whereas the Insured by a proposal and declaration dated as stated in the Schedule which shall be the basis of this contract and is deemed to be incorporated herein has applied to TATA AIG GENERAL INSURANCE COMPANY LTD. (hereinafter called the Company) for the Insurance hereinafter contained and has paid the premium mentioned in the schedule as consideration for such Insurance in respect of accidental loss or damage occurring during the Period of Insurance.

NOW THIS POLICY WITNESSETH:

That subject to the Terms, Exceptions and Conditions contained herein or endorsed or expressed hereon;

SECTION I – LOSS OF OR DAMAGE TO THE VEHICLE INSURED

  1. The Company will indemnify the Insured against loss or damage to the vehicle insured hereunder and/or its accessories whilst thereon: (10)
    • by fire, explosion self-ignition or lightning;
    • by burglary, housebreaking or theft;
    • by riot and strike; (అల్లర్లు మరియు సమ్మె వల్ల)
    • by earthquake (Fire and Shock Damage);
    • by flood, typhoon, hurricane, storm, tempest, inundation, cyclone, hailstorm, frost;
    • by accidental external means;
    • by malicious act; (i.e MAN MADE HAZARDS: the acts of destruction with the intent to damage or destroy property eg: opponents)
    • by terrorist activity;
    • whilst in transit (i.e Shifting) by road rail inland – waterway lift elevator or air;
    • by landslide, rockslide. (కొండచరియలు, రాయి జారడం వల్ల)

self-ignition refers to damage caused by the spontaneous combustion of a vehicle due to internal factors like overheating or chemical reactions. This is typically covered under the “Own Damage” section of a comprehensive motor insurance policy.

Lightning damage is also covered under comprehensive motor insurance. If a vehicle is struck by lightning, it can cause electrical system failures, fires, or structural damage

5. Rate of depreciation for painting:

In the case of painting, depreciation rate of 50% shall be applied only on the material cost of total painting charges. In case of a consolidated bill for painting charges, the material component shall be considered as 25% of the total painting charges for the purpose of applying the depreciation.
6. In the case of repair,

no depreciation shall be deducted on Non-OEM (Original Equipment Manufacturer)/ Non-OES (Original Equipment Supplier) parts that are used in repairs.

  2. The Company shall not be liable to make any payment in respect of:
    • Consequential loss (i.e damages not directly related to accident eg: engine get damaged as you drive the vehicle after accident w/o repairs), depreciation, General wear and tear, mechanical or electrical breakdown, failures or breakages;
    • Damage to tyres and tubes without accident unless the vehicle is damaged at the same time, in which case the liability of the Company shall be limited to 50% of the cost of replacement. (i.e tyres are only covered through for damages in Accident unless you have Tyre Secure) And
    • Any accidental loss or damage suffered whilst the Insured or any person driving the vehicle with the knowledge and consent of the Insured is under the influence of intoxicating liquor or drugs.
  3. In the event of the vehicle being disabled by reason of loss or damage covered under this Policy the Company will bear the reasonable cost of protection and removal to the nearest repairer and redelivery to the insured but not exceeding in all Rs. 1500/- in respect of any one accident.
  4. The insured may authorise (Self Authorization) the repair of the vehicle necessitated by damage for which the Company may be liable under this Policy provided that:
    • the estimated cost of such repair including replacements, if any, does not exceed Rs. 500/-;
    • the company is furnished forthwith with a detailed estimate of the cost of repairs; and
    • the Insured shall give the Company every assistance to see that such repair is necessary and the charges are reasonable.

SUM INSURED – INSURED’S DECLARED VALUE (IDV)

The Insured’s Declared Value (IDV) of the vehicle will be deemed to be the ‘SUM INSURED’ for the purpose of this Policy which is fixed at the commencement of each Period of insurance / policy year (where period of insurance exceeds one year), as the case may be, for the insured vehicle

The IDV of the vehicle (and accessories if any fitted to the vehicle) is to be fixed on the basis of the manufacturer’s listed selling price (ex showroom price) of the brand and model as the vehicle insured at the commencement of insurance/renewal and adjusted for depreciation (as per scheduled below): but in general every year @10%.

The schedule of age-wise depreciation as shown below is applicable for the purpose of Total Loss/Constructive Total Loss (TL/CTL) claims only.

IDV of vehicles beyond 5 years of age and of obsolete models of vehicles (i.e. models which the manufacturers have discontinued to manufacture) is to be determined on the basis of an understanding between the insurer and the insured.

IDV shall be treated as the ‘Market Value’ throughout the Period of insurance / policy year (where period of insurance exceeds one year), as the case may be, without any further depreciation for the purpose of Total Loss (TL)/ Total Theft of the Insured Vehicle (TT) / Constructive Total Loss (CTL) claims.

The insured vehicle shall be treated as a CTL if the aggregate cost of retrieval and/or repair of the vehicle, subject to terms and conditions of the policy, exceeds 75% of the IDV of the vehicle.

SECTION II – LIABILITY TO THIRD PARTIES

Subject to the limits of liability as laid down in the Schedule hereto the Company will indemnify the Insured in the event of an accident caused by or arising out of the use of the vehicle against all sums which the insured shall become legally liable to pay in respect of:

  • death of or bodily injury to any person including occupants carried in the vehicle (provided such occupants are not carried for hire or reward –eg: Auto, Cab etc..) but except so far as it is necessary to meet the requirements of Motor Vehicles Act, the Company shall not be liable where such death or injury arises out of and in the course of the employment of such person by the insured. (Unlimited – based on his income and age it will be decided by court) Eg : CEO 22 Crore, House Wife : 2lakhs
  • damage to property other than property belonging to the insured or held in trust or in the custody or control of the Insured.(upto 7.5 L morethan this owner has to pay)
  1. The Company will pay all costs and expenses incurred with its written consent.
  2. In terms of and subject to the limitations of the indemnity granted by this section to the insured, the Company will indemnify and driver who is driving the vehicle on the insured’s order or with insured’s permission provided that such driver shall as though he/she was the insured observe fulfill and be subject to the Terms Exceptions and Conditions of this Policy in so far as they apply.
  3. In the event of the death of any person entitled to indemnity under this Policy the Company will in respect of the liability incurred by such person indemnify his/her personal representative in terms of and subject to the limitations of this Policy provided that such personal representative shall as though such representative was the insured observe fulfill and be subject to the Terms Exceptions and Conditions of this Policy in so far as they apply.
  4. The Company may at its own option
    • arrange for representation at any Inquest or Fatal Inquiry in respect of any death which may be the subject of indemnity under this Policy, and
    • undertake the defense of proceedings in any Court of Law (MACT (Motor Accidents Claims Tribunal) Court) . in respect of any act or alleged offence causing or relating to any event which may be the subject of indemnity under this Policy.
  • In India, Motor Insurance (Third Party Cover) is compulsory.
  • Exemption: Vehicles operated by Central, State Govt. & Local authority for govt. purpose are exempted.

AVOIDANCE OF CERTAIN TERMS AND RIGHT OF RECOVERY

Nothing in this Policy or any endorsement hereon shall affect the right of any person indemnified by this Policy or any other person to recover an amount under or by virtue of the provisions of the Motor Vehicles Act.

But the Insured shall repay to the Company all sums paid by the Company which the Company would not have been liable to pay but for the said provisions.

APPLICATION OF LIMITS OF INDEMNITY

In the event of any accident involving indemnity to more than one person any limitation by the terms of this Policy and/or of any Endorsement thereon of the amount of any indemnity shall apply to the aggregate amount of indemnity to all persons indemnified and such indemnity shall apply in priority to the insured.

SECTION III – PERSONAL ACCIDENT COVER FOR OWNER-DRIVER

Benefit payment up to `15 Lakhs

The company undertakes to pay compensation as per the following scale for bodily injury/death sustained by the owner-driver of the vehicle, in direct connection with the vehicle insured or whilst driving or mounting into/ dismounting from the vehicle insured or whilst travelling in it as a co-driver, caused by violent, accidental, external and visible means which independent of any other cause shall within six calendar months of such injury result in:

Provided always that

  1. compensation shall be payable under only one of the items (i) to (iv) above in respect of the owner- driver arising out of any one occurrence and the total liability of the insurer shall not in the aggregate exceed the sum of Rs.15 lakhs during any one period of insurance.
  2. No compensation shall be payable in respect of death or bodily injury directly or indirectly wholly or in part arising or resulting from or traceable to
    • (1) intentional self injury suicide or attempted suicide physical defect or infirmity or
    • (2) an accident happening whilst such person is under the influence of intoxicating liquor or drugs.
  3. Such compensation shall be payable directly to the insured or to his/her legal representatives whose receipt shall be the full discharge in respect of the injury to the insured.

This cover is subject to

  • the owner-driver is the registered owner of the vehicle inured herein;
  • the owner-driver is the insured named in this policy;
  • the owner-driver holds an effective driving license, in accordance with the provisions of Rule 3 of the Central Motor Vehicles Rules, 1989, at the time of the accident.
  • Nominee details are mandatory for this cover. Please provide nominee details in proposal form.
  • Paid Driver/ Employees: based on age & Income, as per worksmen compensation act, copensation will be decided.
  • Passenger

Owner Driver: Owner Driving Car (He must have License) —-15Lakhs (AD benefit).

  • if you are buying New car then No need to buy again.
  • Owner Driver —in case you purchased a car on mother name and she dont have License then P.A is not needed.

    • if we have both policies then anyone claim will be accepted.

GENERAL EXCEPTIONS (Exclusions)

(Applicable to all Sections of the Policy)

The Company shall not be liable under this policy in respect of

  1. Any accidental loss or damage and/or liability caused sustained or incurred outside the Geographical Area.
  2. Any claim arising out of any contractual liability;
  3. Any accidental loss or damage and/or liability caused sustained or incurred whilst the vehicle insured herein is
    • being used otherwise than in accordance with the ‘Limitations as to Use’ (‘వినియోగ పరిమితులు’ as per manufacturer and Law) or
      • Hire and Reward, Carriage of goods, Organized racing, Speed Testing, Reliability Trials, Pace making, Use in connection with motor trade
      • being driven by or is for the purpose of being driven by him/her in the charge of any person other than a Driver as stated in the Driver’s Clause (i.e licensed Driver).
  4. AA
    • (a) any accidental loss or damage to any property whatsoever or any loss or expense whatsoever resulting or arising there from or any consequential loss.
    • (b) any liability of whatsoever nature directly or indirectly caused by or contributed to by or arising from ionising radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel. For the purpose of this exception combustion shall include any self sustaining process of nuclear fission;
  5. Any accidental loss or damage or liability directly or indirectly caused by or contributed to by or arising from nuclear weapons material;
  6. Any accidental loss or damage and/or liability directly or indirectly or proximately or remotely occasioned by contributed to by or traceable to or arising out of or in connection with war, invasion (ఆక్రమణ), the act of foreign enemies, hostilities or warlike operations (whether before or after declaration of war) civil war, mutiny rebellion (తిరుగుబాటు), military or usurped power or by any direct or indirect consequence of any of the said occurrences and in the event of any claim hereunder the insured shall prove that the accidental loss or damage and/or liability arose independently of and was in no way connected with or occasioned by or contributed to by or traceable to any of the said occurrences or any consequences thereof and in default of such proof, the Company shall not be liable to make any payment in respect of such a claim.

DEDUCTIBLE

The Company shall not be liable for each and every claim under Section – I (loss of or damage to the vehicle insured) of this Policy in respect of the deductible stated in the Schedule.

For example, if the vehicle’s repair bill is Rs. 10,000, the deductible will be Rs. 1,000 for a
car less than 1500 cc.
Thus, the insurer will contribute Rs. 9,000, and you will contribute
Rs. 1,000. Note that for cars with more than a 1500 cc engine, the Compulsory Deductible
is Rs. 2000
.

Note: For bikes, the compulsory deductible amount is Rs. 100 – 250.

Note USP:

  • does not deduct any salvage amount for partial loss cases, since the salvage deduction itself will be in the range of 10 – 15% for other insurance companies.
  • as we are not deducting salvage value, company take the Scrap.

Admissibility of Claim

  1. You shall take all reasonable steps to safeguard the Vehicle Insured from loss or damage and to maintain it in efficient condition.
  2. Notice of claim must be given by you to us immediately after an actual or potential loss begins or as soon as reasonably possible after actual or potential loss begins.
  3. In the event of any accident or breakdown, the Vehicle Insured shall not be left unattended without proper precautions being taken to prevent further damage or loss. If the Insured Vehicle is driven before the necessary repairs are made, any further damage or extension of the damage will be at your own risk.
  4. If the claim is for theft, Insured should report to the Police as well as Insurer within 48 hrs from theft and obtain an FIR or a written acknowledgement from the Police authorities.
  5. The Company shall not cover claims wherein such loss or damage is arising or resulting from or traceable to intentional self-injury, suicide or attempted suicide physical defect or infirmity.
  6. The Company shall not cover any expense arising or resulting from or traceable to an accident happening whilst You are under the influence of intoxicating liquor or drugs.

GENERAL CONDITIONS

This Policy and the Schedule shall be read together and any word or expression to which a specific meaning has been attached in any part of this Policy or of the Schedule shall bear the same meaning wherever it may appear.

A. Conditions precedent to contract

  1. Premium to be paid for the Period of Insurance before Policy commencement date as opted by insured in the proposal form.
  2. The due observance and fulfillment of the terms conditions and endorsements of this policy in so far as they relate to anything to be done or complied with by the insured and the truth of the statements and answers in the said proposal shall be condition precedent to any liability of the Company to make any payment under this policy.

B. Conditions during the contract

1..Duties and Obligations after Occurrence of an Insured Event

  1. Notice shall be given in writing to the Company immediately upon the occurrence of any accidental loss or damage and in the event of any claim and thereafter the insured shall give all such information and assistance as the Company shall require. Every letter claim writ summons and/or process or copy thereof shall be forwarded to the Company immediately on receipt by the insured.
  2. Notice shall also be given in writing to the Company immediately the insured shall have knowledge of any impending prosecution Inquest or Fatal Inquiry in respect of any occurrence which may give rise to a claim under this policy.
  3. In case of theft or criminal act which may be the subject of a claim under this policy the insured shall give immediate notice to the police and co-operate with the company in securing the conviction of the offender.
  4. No admission offer promise payment or indemnity shall be made or given by or on behalf of the insured without the written consent of the Company which shall be entitled if it so desires to take over and conduct in the name of the insured the defence or settlement of any claim or to prosecute in the name of the insured for its own benefit any claim for indemnity or damages or otherwise and shall have full discretion in the conduct of any proceedings or in the settlement of any claim and the insured shall give all such information and assistance as the Company may require.
  5. At any time after the happening of any event giving rise to a claim under Section II of this Policy the Company may pay to the insured the full amount of the Company’s liability under the Section and relinquish the conduct of any defence settlement or proceedings
  6. The Company may at its own option repair reinstate or replace the vehicle insured or part thereof and/or its accessories or may pay in cash the amount of the loss or damage and the liability of the Company shall not exceed:
    • for total loss / constructive total loss of the vehicle – the Insured’s Declared Value (IDV) of the vehicle (including accessories thereon) as specified in the Schedule less the value of the wreck.
    • for partial losses, i.e. losses other than Total Loss/Constructive Total Loss of the vehicle – actual and reasonable costs of repair and/or replacement of parts lost/damaged subject to depreciation as per limits specified.
    • The Company shall not deduct any amount in lieu of salvage value. Salvage, if any, will be surrendered to the Company and the company shall collect the salvage from the insured.

2. Reasonable Care

The Insured shall take all reasonable steps to safeguard the vehicle insured from loss or damage and to maintain it in efficient condition.

3. Right to Inspect

The Company shall have at all times free and full access to examine the vehicle insured or any part thereof or any driver or employee of the insured. In the event of any accident or breakdown, the vehicle insured shall not be left unattended without proper precautions being taken to prevent further damage or loss and if the vehicle insured be driven before the necessary repairs are effected, any extension of the damage or any further damage to the vehicle shall be entirely at the insured’s own risk.

4. Cancellation

  1. Cancellation by Insurer
    • The Company may cancel the policy on the grounds of established fraud, subject to clause III mentioned under this section, by sending seven days notice by recorded delivery to the insured at insured’s last known address and in which case the policy will be cancelled ‘ab-initio’ with forfeiture of premium and non-consideration of claim, if any.
  2. Cancellation by Insured
    • The policy may be cancelled at any time by the insured without assigning any reason provided no claim has arisen during the period of insurance. , The insured shall be entitled to a refund of proportionate premium for the unexpired period in the running year and full refund of premium for remaining full policy years (where period of insurance exceeds one year) subject to submission of proof that vehicle is insured elsewhere at least for Liability Only cover and original certificate of insurance.
  3. Liability to Third party section of the policy may be cancelled either by the Company or the Insured only on the following grounds :
    • Double Insurance
    • Vehicle not in use anymore because of Total Loss or Constructive Total Loss

On submission of original cancelled Registration Certificate or on providing evidence that the vehicle is insured elsewhere, at least for Liability Only cover on submission of original proof of such insurance. The Company will refund proportionate premium for unexpired period of insurance.

Double Insurance:

When the insured vehicle is covered under another policy with identical cover, then the policy commencing later may be cancelled by the insured subject to the following.

If a vehicle is insured at any time with two different offices of the same insurer, 100% refund of premium of one policy shall be allowed by cancelling the later of the two policies. However, if the two policies are issued by two different insurers, the policy commencing later shall be cancelled by the insurer concerned and pro-rata refund of premium thereon shall be allowed.

If however, due to requirements of Banks/ Financial Institutions, intimated to the insurer in writing, the earlier dated policy is required to be cancelled, then refund of premium will be allowed after retaining premium on pro-rate basis for the period the policy was in force prior to cancellation.

In either case, no refund of premium shall be allowed for such cancellation if any claim has arisen on either of the policies during the period when both the policies were in operation, but prior to cancellation of one of the policies.

5. Contribution

If at the time of occurrence of an event that gives rise to any claim under this policy, there is in existence any other insurance covering the same loss, damage or liability, the Company shall not be liable to pay or contribute more than its ratable proportion of any compensation cost or expense.

6. Change of Vehicle (Eg: Innova to Benz)

Vehicle insured under the policy can be substituted by another private car ( for the balance period of the policy subject to adjustment of premium, if any, on pro-rata basis from the date of substitution on submission of fresh proposal form. Where the vehicle so substituted is not a total loss, evidence in support of continuation of at least Third Party insurance on the substituted vehicle shall be submitted before such substitution.

7. Transfer of Insurance (TRANSFER OF OWNERSHIP)

On transfer of ownership the Liability Only cover shall be deemed to be transferred in favour of the person to whom the motor vehicle is transferred with effect from the date of transfer. The transferee shall apply within fourteen days from the date of transfer in writing for necessary changes in our record and issuance of fresh certificate of insurance/ endorsement..

Transfer of “Own Damage” section of the policy in favour of the transferee, shall be made on receipt of a specific request from the transferee within 14 days from the date of transfer along with, acceptable evidence of sale, consent of the transferor, original old certificate, of insurance for effecting transfer in the record and issuance of fresh Certificate of Insurance/ endorsement in the name of the transferee effective from the date of transfer. If request for transfer is made after 14 days from the date of transfer then transfer will be effective from the date request is received by us and payment of differential premium, if any. If the transferee is not entitled to the benefit of the No Claim Bonus (NCB) shown on the policy, or is entitled to a lesser percentage of NCB than that existing in the policy, recovery of the difference between the transferee’s entitlement, if any, and that shown on policy shall be made before effecting the transfer.

8. No Claim Bonus

No claim bonus can be earned only in the Own damage section of Policies covering all class of vehicles.

Insured is entitled to No Claim Bonus (NCB) at the renewal of the policy. No Claim Bonus (NCB) shall be allowed if no own damage claim is made or pending during the preceding full years (i.e only at the renewal of a policy after the expiry of the full duration of 12 months) of insurance as per the following table subject to terms and conditions mentioned below.

  1. The entitlement of NCB shall follow the fortune of the original insured and not the vehicle or the policy. In the event of transfer of interest in the policy from one insured to another, the entitlement of NCB for the transferee will be as per transferee’s eligibility for Private Car policy following the transfer of interest.
    • In case of Client holds an NCB and obtains a certificate from the company, he/she can take a fresh policy for the vehicle within next 3 years & be eligible to transfer it.
  2. Where the insured is an individual, and on his/ her death the custody and use of the vehicle pass to his/her spouse and/or children and/or parents, the NCB entitlement of the original insured will pass on to such person/s to whom the custody and use of the vehicle passes.
  3. The percentage of NCB earned on a vehicle owned by an institution during the period when it was allotted to and exclusively operated by an employee shall be passed on to the employee if the ownership of the vehicle is transferred in the name of the employee. This will however require submission of a suitable letter from the employer confirming that prior to transfer of ownership of the vehicle to the employee, it was allotted to and exclusively operated by the employee during the period in which the NCB was earned.
  4. In the event of the insured, transferring his insurance from one insurer to another insurer, the transferee insurer shall allow the same rate of NCB which the insured would have received from the previous insurer subject to submission of evidence of the insured’s NCB entitlement either in the form of a renewal notice or a letter confirming the NCB entitlement from the previous insurer.
  5. Where the insured is unable to produce such evidence of NCB entitlement from the previous insurer, the claimed NCB may be permitted after obtaining from the insured a declaration as per the following wording:
    • “I / We declare that the rate of NCB claimed by me/ us is correct and that no claim has arisen in the expiring period of insurance (copy of the policy enclosed). I/We further undertake that if this declaration is found to be incorrect, all benefits under the policy in respect of Section I of the Policy will stand forfeited.”
  6. If an insured vehicle is sold and not replaced immediately, NCB, if any, may be granted only on a subsequent insurance and not any subsisting insurance, provided such fresh insurance is effected within 3 (three) years from the date of sale of insured vehicle. The rate of NCB applicable to the fresh policy shall be that earned at the expiry of the last 12 months period of insurance.
  7. On production of evidence of having earned NCB abroad, an insured shall be granted NCB on a new policy taken out in India as per entitlement earned abroad, provided the policy is taken out in India within three years of expiry of the overseas insurance policy, subject to relevant provisions of NCB mentioned herein. NCB slab will be allowed as per table above corresponding to the claim free years as certified by insurer abroad.
  8. Except as provided in Rule 6 and 7, no NCB will be allowed when a policy is not renewed within 90 days of its expiry.
  9. Except as provided in Rules (6), (7) and (8) above, NCB shall be allowed only when the vehicle has been insured continuously for a period of 12 months without any break.

Note: that such a discount is on the Own Damage component of the Comprehensive Car Insurance Policy.

  2. Insured or claimant shall furnish immediate loss details, which shall include details of the loss event, location of the loss, location of the damaged vehicle, and names and telephone numbers of contact personnel
  3. If the claim is for theft, insured should report to the Police as well as insurer within 48 hrs from theft and obtain an FIR or a written acknowledgement from the Police authorities.

Notice of claim must be given by you to us immediately after an actual or potential loss begins or as soon as reasonably possible after actual or potential loss begins.

If the claim is for theft, Insured should report to the Police as well as Insurer within 48 hrs from theft and obtain an FIR or a written acknowledgement from the Police authorities.

In case of vehicle theft, a police complaint has to be filed immediately after the loss. Please keep the following information ready when you call the call centre:

  • Intimation of claim to TATA AIG through various mediums available (Website – www.tataaig.com, TATA AIG App, WhatsApp – Send “Hi” on “9136160375”, TATA AIG Customer App on Google play & Apple store)
  • Appointment of surveyor by TATA AIG
  • Documents are verified by the Surveyor, and if all documents are in order, repair approval is shared immediately. Tentative list of documents is noted below:
    • Claim Form (in prescribed format duly filled and signed)
    • Registration certificate of the vehicle. (Self-Attested by Insured/verification when required)
    • Driving license of the person driving the vehicle at the time of accident. (Self-Attested by Insured/ verification when required)
    • FIR – (In case of Third-party injuries / Property Damage/major losses)Permit Copy (Commercial Vehicle only)
    • Fitness Certificate (Commercial Vehicle only)
    • Load Challan (Commercial Vehicle only)
    • Theft losses: All the documents as mentioned above along with Police final/untraced report.
    • Repair Bills/Supporting Documents & receipts post repair.
  • The Company may ask for additional information/documents for verification of facts related to your claim, if required
    • Once the repair works are completed by the workshop, re-inspection of the vehicle may be carried out, if required.
    • Upon submission of repair invoice to TATA AIG in case of Cashless claims, delivery order is shared with workshop, post which Insured can take delivery of vehicle.
    • In case of reimbursement claims, Insured will have to submit repair invoice in original and a copy of cancelled cheque to TATA AIG
    • Claim payment is done through NEFT within 7 days from receipt of all relevant documents.

Cashless Claims:

In cashless claims, you just have to pay for the charges that the insurance company does
not cover as per the policy’s terms. For example, you will have to pay for the deductibles,
depreciation, and other extra repairs not covered by the policy. This is because cashless
garages support Cashless Claims. The alternative to this is Reimbursement Claims.

Turn Around Time (TAT) for claims settlement

All claims shall be settled within 7 working days of the receipt of all relevant documents, including original bills & clarifications, if any.

Escalation Matrix when TAT is not satisfied

The Company is committed to extend the best possible services to its customers. However, if you are not satisfied with our services and wish to lodge a complaint, please feel free to email to the customer service desk    at customersupport@tataaig.com.    After investigating the matter internally and subsequent closure, the Company will send our response within a period of 10 daysfrom the date of receipt of the complaint by the Company or its office in Mumbai. In case the resolution is likely to take longer time, the Company will inform you of the same through an interim reply.

Escalation Level 1

For lack of a response or if the resolution still does not meet your expectations, you can write to manager.customersupport@tataaig.com. After investigating the matter internally and subsequent closure, the Company will send our response within a period of 8 days from the date of receipt of your complaint.

Escalation Level 2

For lack of a response or if the resolution still does not meet your expectations, you can write to the Head – Customer Services at head.customerservices@tataaig.com. After examining the matter, the Company will send you our response within a period of 7 days from the date of receipt of your complaint. Within 30 days of lodging a complaint with us, if you do not get a satisfactory response from us and you wish to pursue other avenues for redressal of grievances, you may approach Insurance Ombudsman appointed by IRDA of India under the Insurance Ombudsman Scheme (https://www.cioins.co.in/Ombudsman).

D. Conditions for renewal of the contract

Renewal Notice

The Policy may be renewed with our consent. The benefits under the policy or/and the terms and conditions of the policy, including premium rate may be subject to change.

We, however, are not bound to give notice that it is due for renewal. Unless renewed as herein provided, this Policy shall terminate at the expiration of the period for which premium has been paid / received. No renewal receipt shall be valid unless it is on the printed form of the Company and signed by an authorized official of the Company.

E. Special Conditions

  1. In the event of the death of the sole insured, this policy will not immediately lapse but will remain valid for a period of three months from the date of the death of insured or until the expiry of this policy (whichever is earlier). During the said period, legal heir(s) of the insured to whom the custody and use of the Motor Vehicle passes may apply to have this policy transferred to the name(s) of the heir(s) or obtain a new insurance policy for the Motor Vehicle.
    • Where such legal heir(s) desire(s) to apply for a transfer of this policy or obtain a new policy for the vehicle such heir(s) should make an application to the Company accordingly within the aforesaid period. All such applications should be accompanied by:-
      • Death certificate in respect of the insured
    • Proof of title to the vehicle
    • Original Policy
  2. In the event the claim is not settled within timelines prescribed by IRDAI, the Company shall be liable to pay interest at a rate, which is 2% above the bank rate from the date of receipt of intimation till the date of actual payment.
  3. Failure to furnish evidence within the time required shall not invalidate nor reduce any claim if You can satisfy Us that it was not reasonably possible for You to give the proof within such time.

Auto Secure Endorsements (attached to and forming part of Policy)

IMT1. Extension of Geographical Area

IMT. 3. TRANSFER OF INTEREST

(refer policy schedule) carrying on or engaged in the business or profession of ……………. (refer policy schedule) who shall be deemed to be the insured and whose proposal and declaration dated .. /…/…. Provided always that for the purpose of the No Claim Bonus (except in case of employer-employee transfer as per general condition B.8.3), no period during which the interest in this policy has been vested in any previous Insured shall accrue to the benefit of …..

IMT5. HIRE PURCHASE AGREEMENT

It is hereby understood and agreed that [hereinafter referred to as the Owners (refer Policy Schedule)] are the Owners of the vehicle insured and that the vehicle insured is subject of an Hire’ Purchase Agreement made between the Owners on the one part and the insured on the other part and it is further understood and agreed that the Owners are interested in any monies which but for this Endorsement would be, payable to the insured under this Policy in respect of such loss or damage to the vehicle insured as cannot be made good by repair and/or replacement of parts and such monies shall be paid to the Owners as long as they are the Owners of the vehicle insured and their receipt shall be a full and final discharge to the insurer in respect of such loss or damage.

It is further declared and agreed that for the purpose of the Personal Accident Cover for the owner-driver granted under this Policy, the insured named in the Policy will continue to be deemed as the owner-driver subject to compliance of provisions of the Policy relating to this cover.

Save as by this Endorsement expressly agreed nothing herein shall modify or affect the rights and liabilities of the insured or the insurer respectively under or in connection with this Policy.

Subject otherwise to the terms exceptions conditions and limitations of this Policy.

IMT6. LEASE AGREEMENT

It is hereby understood and agreed that  [hereinafter referred to as the Lessors (refer Policy Schedule)] are the Owners of the vehicle insured and that the vehicle insured is the subject of a Lease Agreement made between the Lessor on the one part and the insured on the other part and it is further understood and agreed that the Lessors are interested in any monies which but for this Endorsement would be payable to the insured under this Policy in respect of such loss or damage to the vehicle insured as cannot be made good by repair and/or replacement of parts and such monies shall be paid to the Lessors as long as they are the owners of the vehicle insured and their receipt shall be a full and final discharge to the insurer in respect of such loss or damage. It is also understood and agreed that notwithstanding any provision in the Leasing Agreement to the contrary, this Policy is issued to the insured namely.           (refer Policy Schedule) as the principal party and not as agent or trustee and nothing herein contained shall be construed as constituting the insured an agent or trustee for the Lessors or as an assignment (whether legal or equitable) by the insured to the Lessors, of his rights benefits and claims under this Policy and further nothing herein shall be construed as creating or vesting any right in the Owner/Lessor to sue the insurer in any capacity whatsoever for any alleged breach of its obligations hereunder.

It is further declared and agreed that for the purpose of the Personal Accident Cover for the owner-driver granted under this Policy, the insured named in the Policy will continue to be deemed as the owner-driver subject to compliance of provisions of the Policy relating to this cover.

Save as by this Endorsement expressly agreed nothing herein shall modify or affect the rights and liabilities of the insured or the insurer respectively under or in connection with this Policy.

IMT7. VEHICLE SUBJECT TO HYPOTHECATION AGREEMENT

It is hereby declared and agreed that the vehicle insured is pledged to /hypothecated with …………………………. [hereinafter referred to as the “Pledgee” (refer Policy Schedule)] and it is further understood and agreed that the Pledgee is interested in any monies which but for this Endorsement would be payable to the insured under this Policy in respect of such loss or damage to the vehicle insured as cannot be made good by repair and/or replacement of parts and such monies shall be paid to the Pledgee as long as they are the Pledgee of the vehicle insured and their receipt shall be a full and final discharge to the insurer in respect of such loss or damage.

It is further declared and agreed that for the purpose of the Personal Accident Cover for the owner-driver granted under this Policy, the insured named in the Policy will continue to be deemed as the owner-driver subject to compliance of provisions of the Policy relating to this cover.

Save as by this Endorsement expressly agreed that nothing herein shall modify or affect the rights or liabilities of the insured or the insurer respectively under or in connection with this Policy or any term, provision or condition thereof.

IMT8. DISCOUNT FOR MEMBERSHIP OF RECOGNISED AUTOMOBILE ASSOCIATIONS

It is hereby understood and agreed that in consideration of insured’s membership of ………………** a discount

It is further understood and agreed that if the insured ceases to be a member of the above mentioned association during the currency of this Policy the insured shall immediately notify the insurer accordingly and refund to the insurer a proportionate amount of the discount allowed on this account for the unexpired period of the cover.

IMT10. INSTALLATION OF ANTI-THEFT DEVICE

In consideration of certification by …………………* that an Anti-Theft device approved by Automobile Research Association of India (ARAI), Pune has been installed in the vehicle insured herein a premium discount of Rs…………** is hereby allowed to the insured.

It is hereby understood and agreed that the insured shall ensure at all times that this Anti-theft device installed in the vehicle insured is maintained in efficient condition till the expiry of this policy.

Subject otherwise to the terms, exceptions, conditions and limitations of the policy

An anti-theft device is a gadget that can be installed in your vehicle to prevent vehicle
theft.
Such devices can trigger an alarm and/or have an in-built GPS for tracking.
Consider installing anti-theft devices that are certified by the Automotive Research
Association of India (ARAI).
Installing such devices increases your vehicle’s safety quotient and decreases the
chances of theft.
As the theft risk is reduced, the insurer’s risk of insuring the vehicle
is also reduced. This reduced risk will usually mean a lower premium amount payable.

IMT.12. DISCOUNT FOR SPECIALLY DESIGNED/ MODIFIED VEHICLES FOR THE BLIND, HANDICAPPED AND MENTALLY CHALLENGED PERSONS.

Notwithstanding anything to the contrary contained in the policy it is hereby understood and agreed that the vehicle insured being specially designed /modified for use of blind, handicapped and mentally challenged persons and suitable endorsement to this effect having been incorporated in the Registration Book by the Registering Authority, a discount of 50% on the Own Damage premium for the vehicle insured is hereby allowed to the insured.

IMT 13. USE OF VEHICLE WITHIN INSURED’S OWN PREMISES

It is hereby understood and agreed that the insurer shall not be liable in respect of the vehicle insured while the vehicle is being used elsewhere than in the insured’s premises except where the vehicle is specifically required for a mission to fight a fire.

For the purposes of this endorsement ‘Use confined to own premises’ shall mean use only on insured’s premises to which public have no general right of access.

IMT15. PERSONAL ACCIDENT COVER TO THE INSURED OR ANY NAMED PERSON OTHER THAN PAID DRIVER OR CLEANER

In consideration of the payment of an additional premium it is hereby agreed and understood that the Company undertakes to pay compensation on the scale provided below for bodily injury as hereinafter defined sustained by the insured person in direct connection with the vehicle insured or whilst mounting and dismounting from or traveling in vehicle insured and caused by violent accidental external and visible means which independently of any other cause shall within six calendar months of the occurrence of such injury result in:

  • such compensation shall be payable only with the approval of the insured named in the Policy and directly to the injured person or his/her legal representative(s) whose receipt shall be a full discharge in respect of the injury of such person.

IMT16. PERSONAL ACCIDENT TO UNNAMED PASSENGERS OTHER THAN INSURED AND THE PAID DRIVER AND CLEANER

{For vehicles rated as Private cars and Motorised two wheelers (not for hire or reward) with or without side car}

In consideration of the payment of an additional premium it is hereby understood and agreed that the insurer undertakes to pay compensation on the scale provided below for bodily injuries hereinafter defined sustained by any passenger other than the insured and/or the paid driver attendant or cleaner and/or a person in the employ of the insured coming within the scope of the Workmen’s Compensation Act, 1923 and subsequent amendments of the said Act and engaged in and upon the service of the insured at the time such injury is sustained whilst mounting into, dismounting from or traveling in the insured motor car and caused by violent, accidental, external and visible means which independently of any other cause shall within three calendar months of the occurrence of such injury result in;

IMT17. PERSONAL ACCIDENT  COVER  TO   PAID DRIVERS, CLEANERS AND CONDUCTORS

In consideration of the payment of an additional premium, it is hereby understood and agreed that the insurer undertakes to pay compensation on the scale provided below for bodily injury as hereinafter defined sustained by the paid driver/cleaner/conductor in the employ of the insured in direct connection with the vehicle insured whilst mounting into dismounting from or travelling in the insured vehicle and caused by violent accidental external and visible means which independently of any other cause shall within six calendar months of the occurrence of such injury result in;

  • such compensation shall be payable only with the approval of the insured named in the Policy and directly to the injured person or his/her legal representative(s) whose receipt shall be a full discharge in respect of the injury of such person.

IMT19. COVER FOR VEHICLES IMPORTED WITHOUT CUSTOMS DUTY

Notwithstanding anything to the contrary contained in this Policy it is hereby understood and agreed that in the event of loss or damage to the vehicle insured and/ or its accessories necessitating the supply of a part not obtainable from stocks held in the country in which the vehicle insured is held for repair or in the event of the insurer exercising the option under Condition B.1.6 to pay in cash the amount of the loss or damage the liability of the insurer in respect of any such part shall be limited to:

  • (i) the price quoted in the latest catalogue or the price list issued by the Manufacturer or his Agent for the country in which the vehicle insured is held for repair less depreciation applicable;

OR

(ii) if no such catalogue or price list exists the price list obtaining at the Manufacturer’s Works plus the reasonable cost of transport otherwise than by air to the country in which the vehicle insured is held for repair and the amount of the relative import duty less depreciation applicable under the Policy; and

  • the reasonable cost of fitting such parts,

Subject otherwise to the terms conditions limitations and exceptions of this Policy.

IMT20.REDUCTION IN THE LIMIT OF LIABILITY FOR PROPERTY DAMAGE

It is hereby understood and agreed that notwithstanding anything to the contrary contained in the Policy the insurers liability is limited to Rs. 6000/- (Rupees six thousand only) for damage to property other than the property belonging to the insured or held in trust or in custody or control of the insured.

In consideration of this reduction in the limit of liability a reduction in premium of Rs. 100/- for Private Cars is hereby made to the insured.

Subject otherwise to the terms conditions limitations and exceptions of the Policy.

IMT22.COMPULSORY DEDUCTIBLE

Notwithstanding anything to the contrary contained in the Policy it is hereby understood and agreed that the insured shall bear under Section I of the Policy in respect of each and every event (including event giving rise to a total loss/constructive total loss) the first Rs.  * (refer Policy Schedule) (or any less expenditure which may incurred) or any expenditure for which provision has been made under this Policy and/or of any expenditure by the insurer in the exercise of his discretion under Condition no. B.1.6 for Private Cars/Two wheeler Policy.

In consideration of the above, it is hereby understood and agreed that the insured shall bear under Section 1 of the policy in respect of each and every event (including event giving rise to a total loss/constructive total loss) the first Rs……(refer policy schedule) or (any less expenditure which may be incurred) of any expenditure for which provision has been made under this policy and/or of any expenditure by the insurer in the exercise of his discretion under Condition no. B.1.6 of this policy.

IMT24. ELECTRICAL/ELECTRONIC FITTINGS

(Items fitted in the vehicle but not included in the manufacturer’s listed selling price of the vehicle – Package Policy only)

In consideration of the payment of additional premium of Rs  (refer Policy Schedule) notwithstanding anything to the contrary contained in the Policy it is hereby understood and agreed that the insurer will indemnify the insured against loss of or damage to such electrical and/or electronic fitting(s) as specified in the schedule whilst it/these is/are fitted in or on the vehicle insured where such loss or damage is occasioned by any of the perils mentioned in Section 1 of the Policy. The insurer shall, however, not be liable for loss of or damage to such fitting(s) caused by/as a result of mechanical or electrical breakdown. Provided always that the liability of the insurer hereunder shall not exceed the Insured’s Declared Value (IDV) of the item. Subject otherwise to the terms conditions limitations and exceptions of this Policy.

IMT.25. CNG/LPG KIT IN BI-FUEL SYSTEM (Own

Damage cover for the kit)

In consideration of the payment of premium of Rs…………… notwithstanding anything to the contrary contained in the policy it is hereby understood and agreed that the insurer will indemnify the insured in terms conditions limitations and exceptions of Section 1 of the policy against loss and/or damage to the CNG/LPG kit fitted in the vehicle insured arising from an accidental loss or damage to the vehicle insured, subject to the limit of the Insured’s Declared Value of the CNG/LPG kit specified in the Schedule of the policy.

Subject otherwise to the terms conditions limitations and exceptions of this Policy.

IMT.26. FIRE AND/OR THEFT RISKS ONLY

Notwithstanding anything to the contrary contained in the policy it is hereby understood and agreed that Section II of the Policy is deemed to be cancelled and under Section I thereof the insurer shall only be liable to indemnify the insured against loss or damage by fire explosion self ignition lightning and/or burglary housebreaking theft and riot strike malicious damage terrorism storm tempest flood inundation and earthquake perils whilst the vehicle is laid up in garage and not in use.

Subject otherwise to the terms conditions limitations and exceptions of this Policy.

NB.(i) In case of Fire Risk only, the words “burglary housebreaking theft” are to be deleted.

NB.(ii) In case of Theft Risk only, the words “fire explosion self ignition lightning riot strike malicious damage terrorism storm tempest flood inundation and earthquake perils” are to be deleted.

IMT27. LIABILITY AND FIRE AND/OR THEFT

Notwithstanding anything to the contrary contained in the Policy it is hereby understood and agreed the Section I of the Policy the insurer shall not be liable there under except in respect of loss or damage by fire explosion self ignition lightning and/or burglary housebreaking theft and riot strike malicious damage terrorism storm tempest flood inundation and earthquake perils.

Subject otherwise to the terms conditions limitations and exceptions of the Policy.

NB. (i) In case of Liability and Fire Risks only, the words “burglary housebreaking theft” are to be deleted.

IMT28. LEGAL LIABILITY TO PAID DRIVER AND/ OR CONDUCTOR AND/OR CLEANER EMPLOYED IN CONNECTION WITH THE OPERAION OF INSURED VEHICLE

In consideration of an additional premium of Rs. 50/- notwithstanding anything to the contrary contained in the Policy it is hereby understood and agreed that the insurer shall indemnify the insured against the insured’s legal liability under the Workmen’s Compensation Act, 1923, the Fatal Accidents Act, 1855 or at Common Law and subsequent amendments of these Acts prior to the date of this Endorsement in respect of personal injury to any paid driver and/or conductor and/or cleaner whilst engaged in the service of the insured in such occupation in connection with the vehicle insured herein and will in addition be responsible for all costs and expenses incurred with its written consent.

Provided always that:

  • this Endorsement does not indemnify the insured in respect of any liability in cases where the insured holds or subsequently effects with any insurer or group of insurers a Policy of Insurance in respect of liability as herein “defined for insured’s general employees;
  • the insured shall take reasonable precautions to prevent accidents and shall comply with all statutory obligations;
  • in the event of the Policy being cancelled at the request of the insured no refund of the premium paid in respect of this Endorsement will be allowed.

Subject otherwise to the terms conditions limitations and exceptions of the Policy except so far as necessary to meet the requirements of the Motor Vehicles Act, 1988.

IMT29. LEGAL LIABILITY TO EMPLOYEES OF THE INSURED OTHER THAN PAID DRIVER AND/OR CONDUCTOR AND/OR CLEANER WHO MAY BE TRAVELLING OR DRIVING IN THE EMPLOYER’S CAR.

In consideration of the payment of an additional premium @ Rs. 50/- per employee insured notwithstanding anything to the contrary contained in the policy it is hereby understood and agreed that the insurer will indemnify the insured against the insured’s liability at Common Law and Statutory Liability under the Fatal Accidents Act, 1855 for compensation (including legal costs of any claimant) for death of or bodily injury to any employee (other than paid drivers) of the within named insured being carried in or upon or entering in or getting on to or alighting from or driving the vehicle insured.

Provided that in the event of an accident, whilst the vehicle insured is carrying more than 5 employees of the insured (including the driver), the insured shall repay to the insurer a rateable proportion of the total amount payable by the insurer by the reason of this endorsement in respect of accident in connection with such vehicle insured.

IMT.32. ACCIDENTS TO SOLDIERS /SAILORS/ AIRMEN EMPLOYED AS DRIVERS

In consideration of the payment of an additional premium of Rs 100/-* it is hereby understood and agreed that in the event of any Soldier/Sailor/Airman employed by the insured to drive the vehicle insured being injured or killed whilst so employed, this policy will extend to relieve the insured of his liability to indemnify Ministry of Defence under the respective Regulations.

The allowance would be payable for a maximum period of 10 days during the period of insurance. In case of theft/total loss claim, we will pay for maximum 15 days during the period of insurance.

Reasonable time taken for repair in respect of damages not admissible under section 1 of the policy (as agreed between you, surveyor & garage/workshop manager) would be excluded for the purpose of computation of Daily Allowance.

Your entitlement of Daily Allowance will start from the following calendar day of Your Vehicle reaching the garage for repair or the day of intimation of claim to Us, whichever is later and shall end on the day garage intimates you to take delivery of the Vehicle.

In consideration of payment of additional premium, We will pay the difference between Insured’s Declared Value (IDV) of the insured vehicle and on-road price (including electronic/electrical/non electrical/electronic accessories/bi-fuel kit provided by manufacturer/dealer) of a new vehicle of similar make and model published by manufacturer/dealer in case of Total Loss/Constructive Total Loss/Theft of your vehicle. On road price shall include registration fees, road tax & Insurance charges Excluding GST.

We will also pay for the lubricating oils/consumables used in the respective assembly i.e. material, which is used up and needs continuous replenishment such as engine oil, gear box oil etc. but excluding fuel.

What is not covered /Exclusions:

We shall not indemnify you under this endorsement in respect of-

  1. Loss or damage covered under manufacturer warranty; recall campaign or forming part of maintenance/preventive maintenance.
  2. Any aggravation of loss or damage including corrosion due to delay in intimation to us and/or retrieving the vehicle from water logged area.
  3. Ageing, depreciation, wear and tear.

  1. In case of water damage, there is and evidence of vehicle being submerged or stopped in water logged area.

This cover is applicable if it shown on your schedule.

What is covered

We will cover expenses for repair and/or replacement, as may be necessitated arising out of accidental loss or damage to tyres and tubes only, without any damage to the insured vehicle, resulting into bulge, puncture, burst, cut, or damage as specified below. Unused tread depth will be the basis of indemnity under this coverage as specified in the policy.

In any situation company’s liability would not exceed the following, basis the unused tread depth of respective tyre (not applicable if Full cover is opted)-

  • Unused tread depth of <3 mm – Considered as normal wear and tear and is not covered.
  • Unused tread depth of >=3 mm to <5 mm – 50% of cost of new tyre and/or tube.
  • Unused tread depth of >=5 to < 7 mm – 75% of cost of new tyre and/or tube
  • Unused tread depth of > = 7 mm – 100% of cost of new tyre and/or tube

Unused Tread depth will be measured at the centre of the tread. Minimum 4 measurements at 4 different places will be taken for the purpose of arriving at means tread depth which will be the basis of indemnity under the coverage.

Whenever replacement of tyre will be allowed it will be of the same make and specification and if tyre of similar specification is not available and replaced tyre is superior to damaged tyre then We will not be liable for betterment charges. Maximum of 4 (four) replacements will be allowed during the Period of Insurance.

If damage to tyre and tube is due to the accidental damage to the insured vehicle covered under “Own Damage” section of the policy. Our liability under this cover will be restricted to the difference of depreciation percentage applied under “Own Damage” section and as mentioned above basis the unused tread depth.

What is not covered

  1. If vehicle is not repaired at Authorized garage.
  2. loss or damage arising out of natural wear and tear including unevenly worn tyres caused by defective steering geometry outside manufacturer’s recommended limits or wheel balance, failure of suspension component, wheel bearing or shock absorber.
  3. any loss or damage within first 15 days of inception of the policy.
  4. any loss or damage occurred prior to inception of the policy
  5. any loss or damage resulting into total loss of the vehicle.
  6. routine maintenance including adjustment, alignment, balancing or rotation of wheels/tyres/ tubes
  7. Loss or damage to wheel accessories, any other parts or rim.
  8. theft of tyre(s)/tube(s) or its parts accessories without vehicle being stolen or theft of entire vehicle.
  9. if the tyre(s)/tube(s) being claimed is different from tyre(s) insured/supplied as original equipment along with the vehicle unless informed to us and mentioned/endorsed on the policy.
  10. fraudulent act committed by insured or the workshop or any person entrusted possession of the vehicle by insured.
  11. loss or damage arising out of improper storage or transportation
  12. any consequential loss or damage such as but not limited to noises, vibrations and sensations that do not affect tyre function or performance.
  13. loss or damage arising out of modifications not approved by tyre manufacturer.
  14. loss or damage resulting from hard driving due to race, rally or illegal activities.
  15. loss or damage due to neglect of periodic maintenance as specified by manufacturer.
  16. loss or damage resulting from poor workmanship while repair.
  17. loss or damage arising out of any manufacturing defect or design including manufacturer’s recall.
  18. minor damage or scratch not affecting the functioning
  19. tyre which has been used for its full specified life as per manufacturer’s guideline or where unused tread depth is less than 3 mm.

Important Conditions

  1. If you make a fraudulent claim which is declined as per para 10 of “What We will not cover”, coverage under this section shall cease with immediate effect.
  2. If during the Period of insurance any tyre is replaced for any reason for which claim is not preferred under the coverage, cover on new tyre would not be available unless details of new tyre are informed to us.
  3. In case of replacement of tyre for which a claim is preferred under the coverage replaced tyre can be included by way of endorsement by paying requisite premium.
  4. All claims must be made within 3 working days of damage.
  5. You must take all reasonable steps to avoid loss or damage to tyre(s). You must not continue to drive the vehicle after any damage or incident if this could cause further damage to tyre(s).

Consumable for the purpose of this cover shall include engine oil, gear box oil, lubricants, nut & bolt, screw, distilled water, grease, oil filter, bearing, washers, clip, break oil, air conditioner gas and items of similar nature excluding fuel.

What is not covered

  1. Any consumable not associated with admissible Own Damage claim under section I (Own Damage) of the policy.
  2. If there is no valid and admissible claim under section I (Own Damage) of the policy.
  3. If vehicle is not repaired at Authorized garage.

Consumables:

Car repair can be a tedious task for the mechanic if the damage is substantial. Depending
upon the complexities of the damages, the mechanic uses several consumables to repair
the car. For instance, the mechanic might use nuts and bolts, engine oil, ball bearings,
lubricants, screws, etc. The expenses incurred for such minor tools/usable items are
termed as Consumables. The insurer does not cover such costs unless you have a
Consumables Add-on Cover.

These services will be offered to you during the Period of Insurance as mentioned on your Policy Schedule or Certificate of Insurance.

It’s a service facilitated to take care of your vehicle and your worries in an unfortunate event of your vehicle meeting with an accident or breakdown. Under this, we provide wide range of services in form of assistance for your help within the covered geographical territory.

General Note:

  • Only Services Provided but cost you have to bear
  • Eg: Petrol cost you have to bear but Rapido Cost you no need to bear).
  • Accident: upto 50kms free service
  • Normal: Upto 25kms free service

Repair and Towing Assistance

Service for Flat Tyre

In the event insured Vehicle is immobilized due to a flat tyre, you will get the assistance of a vehicle technician to replace the flat tyre with the spare stepney tyre of the Vehicle at the location of breakdown. In case the spare tyre is not available in the insured Vehicle, the flat tyre will be taken to the nearest flat tyre repair shop for repairs & re-attached to the Vehicle. All incidental charges for transporting the tyre to the repair shop and its repair cost shall be borne by you.

Flat Battery – Jump Start Service

In the event insured Vehicle is immobilized, due to rundown battery, you will get the assistance of a Vehicle technician to jump start the Vehicle with appropriate means. If the run down battery has to be replaced with a new battery, the cost of such battery replacement and any costs to obtain the battery will be borne by you. All costs involved in charging of the run down battery will also be borne by you.

Repair on the spot

In the event insured Vehicle breaks down due to a minor mechanical / electrical fault making it immobile and immediate repair on the spot is deemed possible, you will get the assistance of a vehicle technician for repairing the breakdown at the location of breakdown. Cost of Material & Spare Parts, if required, to repair the vehicle on the spot and any other incidental conveyance to obtain such material & spare parts will be borne by you.

Spare Key Retrieval / Service for Keys Locked Inside

If the keys of the insured vehicle are locked inside the vehicle, lost, or misplaced, and in case you need and request to arrange for another set from your place of residence or office by courier to the location of the vehicle, the same will be arranged after receiving the requisite authorizations from you with regards to the person designated to hand over the same. You may be requested to submit an identity proof at the time of delivery of the keys. Alternatively, at your request, you will be assisted by a car technician to attempt to open the car with normally available tools at the location of the event. Identity proof for matching with car ownership information on record will be required prior to attempting this service.

Fuel Support (Emergency Fuel Delivery)

In the event insured Vehicle runs out of fuel and hence is immobilized, you will get the assistance of emergency fuel (up to 5 liters on a chargeable basis) at the location of breakdown.

Emergency Towing Assistance

In case of Break-down:

In the event insured Vehicle suffers an immobilizing break down due to a mechanical or electrical fault

which cannot be repaired on the spot, you will get the assistance in towing the vehicle to the nearest garage, using the best available towing mechanism, within a radius of 25 Kms. from the location of the breakdown. In case the towing distance exceeds the mentioned limit, you will be informed of the expected additional costs, which will need to be paid by you to the vendor at vendor’s actual rates.

In case of an Accident:

In the event insured Vehicle suffers an immobilizing break down due to an accident, you will get the assistance in towing the vehicle to the nearest garage, using the appropriate towing mechanism within a radius of 25 Kms. from the location of the breakdown. In case the towing distance exceeds the mentioned limit, you will be informed of the expected additional costs, which will need to be paid by you at the vendor’s actual rates.

Concierge Services:

SMS Relays/Emergency Message Service

In the event of breakdown or accident to your insured vehicle under our policy your urgent messages will be relayed to a person of your choice.

Continuation / Return Journey (Taxi Support)

In the event the insured vehicle is immobilized due to a breakdown, outside the municipal/corporation limits of your home city, and the vehicle cannot be repaired the same day, you will get the assistance for arrangement of alternate mode of transport (Taxi) to continue the journey or return to your home town from the location of the breakdown. In the normal course “C” Class vehicles (as per widely used categorization of the automobile industry) will be arranged on a best effort basis. However, in case the same is not available owing to geographical or other constraints, you will be provided the next best class of vehicle available. Taxi fare for the journey will be borne by you and shall be paid directly to the vendor.

Hotel Accommodation

In the event insured vehicle is immobilized due to a breakdown which has taken place and cannot be repaired the same day, you will get the assistance in organizing for Hotel accommodation near the location of the event. You will have to bear the cost of stay and you will be informed of the amount to be paid in advance directly to the Hotel.

Pick up of repaired vehicle

In the event insured Vehicle suffers an immobilizing breakdown/accident which is outside the limits of your home city, and the vehicle is towed to the nearest garage which determines that the vehicle cannot be repaired the same day, you will get the assistance to pick the vehicle from the location of incident and transport it to the desired location by providing driver facility service after the vehicle is fully repaired. The cost of driver shall be borne by you.

Important Note: You will not be required to pay for labor cost and round-trip conveyance costs of the service provider except cost of material/spare parts and conveyance/transportation cost to obtain them, if required, to repair the Vehicle and any other cost specifically mentioned in the above services.

Further, If your insured vehicle is immobilized due to breakdown, and is eligible for services, but as a rare chance, you do not get the eligible assistance as mentioned above, you will be reimbursed the costs incurred for towing the insured Vehicle to the nearest garage not exceeding Rs.2000/- per event for towing or Rs.250/- per event for other services. To qualify for reimbursement, you must have called the toll free number and obtained an authorization, prior to availing external service and must provide necessary documents justifying the event and the actual costs borne.

Geographical territory:

These services are available on National highways, state highways and motorable roads of cities within mainland India, except in the states of Mizoram, Nagaland, Tripura, Arunachal Pradesh, Sikkim.

LIMITATIONS:

  1. The Services will be provided on a best effort basis, subject to regulations in force locally.
  2. The services would not be provided under following conditions:
    • Acts of God (including exceptional adverse weather conditions), earthquake, fire (not caused by the negligence of either party), war (declared or undeclared), invasion, rebellion, revolt, riot (other than among employees of either party), civil commotion, civil war, acts of terrorism, nuclear fission, strike, act(s) of omission/commission by any concerned, Government(s), or government agencies, judicial or quasi-judicial authorities.
  3. loss of or damage to luggage or other personal effects that might occur during the services performance.
  4. Vehicles should not be used for the purpose of racing, rallying, motor-sports, or in any instance where the Vehicle is not being used /driven in accordance with applicable laws and regulations.
  5. Not covered events: Any service not-covered here, if provided shall be at your own expense.
  6. Load carried in the vehicle such as boats, motor vehicles, gliders, or animals (horses, cattle…), merchandise, perishable goods, research and scientific equipment, building equipment, furniture, etc. shall not be transported.
  7. You can avail of these services for maximum of 4 times during the course of the Period of Insurance.

  • Take all reasonable measures to limit and prevent possible consequences of the Breakdown
  • Provide the your / user beneficiary Information.

In order to entitle the relevant Users to the Services, the insured Vehicle must be immobilized within the Covered geographical territory. A vehicle is considered as immobilized as long as it cannot be driven as a result of a breakdown or an accident. However, the state of being out of use for maintenance or repair purposes is not considered as immobilization.

TA21- Additional Third Party Property Damage Cover (UIN: IRDAN108RP0002V01200001/A0003V01202021)

This cover is applicable if it is shown on Your schedule.

We will pay for damage to property other than the property belonging to You or held in Your trust, custody and control up to the limit specified in Your schedule provided that damage to property is solely and directly caused by accident by the insured vehicle.

It provides additional protection against third party property damage which is over and above what is covered under the policy.

The above limit is in respect of any one claim or series of claims arising out of one event/occurrence in excess of maximum limit of liability covered under Section II of the policy.

Maximum limit of one claim or series of claims arising out of one event /occurrence will be Rs. 25.lacs.

Additional Third-party Property Damage Cover1,00,000 to 25,00,000 (in multiples of 50,000)

TA 22 – Emergency Medical Expenses (UIN IRDAN108RP0002V01200001/A0008V01202021)

This cover is applicable if it is shown on Your schedule.

What is covered:

We will pay emergency medical expenses incurred by You for treatment of bodily injury/ies sustained by You / Driver /Occupant in the vehicle in direct connection with the insured vehicle whilst mounting and dismounting from or driving or travelling in the insured vehicle and caused by violent, accidental external and visible means and required treatment is taken in a Hospital / Nursing Home.

Reasonable Ambulance charges for shifting injured from the site of accident to the hospital/ nursing home.

We will pay Ambulance Charges, up to the Sum Insured specified in the schedule, incurred by You towards transportation of You / driver / person to the Hospital / Nursing Home post suffering bodily injury.

We will also pay the cost of supporting items not limited to items like crutches, wheelchair, artificial limbs, which become necessary after an accident, up to a maximum amount of Rs. 5,000 or 5% of the Sum Insured opted by You, whichever is less.

Our liability in aggregate during the Period of insurance shall be limited to sum insured as specified in the schedule for persons not exceeding the maximum licensed seating capacity of the vehicle.

Special Condition:
• Claim under this benefit will be admissible, only if the injury is sustained while travelling in the insured vehicle as a driver or occupant.

What is not Covered:

  • Any expenses related to a sickness, disease or medical disorder not directly consequential to accident.
  • Any expenses towards psychosomatic disorders of any kind, whether caused or accentuated by accident or otherwise.
  • Any physiotherapy treatment.
  • Any expense not supported by an original and valid bill / receipt and related prescription of the attending Medical Practitioner / Hospital / Nursing Home.
  • Expenses, if the treatment is started after 5 days from the date of Accident
  • Not more than sum-insured as mentioned in the schedule during period of policy.
  • Any expense arising or resulting from or traceable to intentional self injury, suicide or attempted suicide physical defect or infirmity.
  • Any expense arising or resulting from or traceable to an accident happening whilst You are under the influence of intoxicating liquor or drugs.

This additional protection can be opted for any amount between Rs. 25,000 to Rs.1,00,000 in a multiple of Rs
5,000/-.

TA23 – Additional Towing Charges (UIN IRDAN108RP0002V01200001/A0009V01202021)

This cover is applicable if it is shown on Your schedule.

What is covered:

It provides additional protection against vehicle towing charges which is over and above what is covered under the policy.

We will pay You the cost of towing the Insured Vehicle to the nearest Garage/Service station in the event of insured vehicle being disabled by any reason of loss or damage covered under Section I of the policy in addition to the amount covered in section I of the policy subject to maximum amount as specified in the schedule and submission of proof of expenses incurred by You.

This additional Towing Charges can be opted for any amount between Rs. 5,000 to Rs.50,000 in a multiple of Rs 5,000/-. This cover is available maximum limit of Rs. 50,000.

What is not Covered:

  • Towing charges incurred if claim under section I of the policy is not admissible.
  • Consequential Losses
  • Loss covered under Manufacturer’s Warranty or recall campaign.

TA24- Misfuelling (UIN IRDAN108RP0002V01200001/A0004V01202021)

This section is applicable if it is shown on Your schedule.

We will pay the cost of flushing out the wrong/adulterated fuel filled at fuel filling station including replacement of parts damaged due to wrong fueling.

We will also (In addition to above) reimburse the cost of wrong/adulterated fuel up to maximum of Rs.2000/- on submission of bill.

Maximum number of claims permissible in a Period of Insurance is restricted to one (1).

This cover is also subject to the terms, exceptions, conditions and limitations of the policy. Sum insured will be the maximum limit under this cover.

MisfuellingIDV

TA29 Electric Surge Secure – Private Car Annual Package – (UIN: IRDAN108RP0002V01200001/ A0009V01202223)

This cover is applicable if it is shown on Your Policy schedule.

We will pay you for partial or total or constructive total loss, destruction or damage to Electric vehicle including Charging equipment arising out of arcing, self heating, leakage of electricity or short circuiting including due to ingress of water.

Our maximum liability will be limited to Insured Declared Value (IDV) mentioned in the policy schedule.

What is not Covered:

We shall not indemnify You in respect of-

  • Loss or damage due to any Manufacturing Defect.
  • Loss arising as a result of failure to follow the manufacturer’s instructions.
  • Use of batteries, charger and / or accessories not as per approved specification by the manufacturer.When Battery is charged not in accordance with manufacturer’s instruction.
  • loss or damage to the battery fitted in the vehicle unless cost of the battery is included in IDV or endorsed in the policy.
  • Conventional SLI (Starting, Lighting and Ignition) battery will not be covered under this Add On.

Special Condition:

In the event of an accident, we will indemnify under this add-on only if sufficient evidence of under carriage damage to Battery.

TA30 – Depreciation allowance – Battery – Private Car Annual Package (UIN: IRDAN108RP0002V01200001/ A0010V01202223)

This cover is applicable if it is shown on your Policy schedule.

We will pay you the amount of depreciation deducted on the value of the Battery replaced under Own Damage claim, lodged under section 1 (Loss of or Damage to the Vehicle Insured) of the policy. We will pay for the first <number of > claims during the period of insurance as mentioned in the Policy schedule.

Deductible is in the form of two options

  • Zero deductible
  • 5% of claim amount and minimum of Rs. 500 for each and every claim

TA25 – Auto Secure – PC Package Policy – Vehicle Loan Protector (UIN: IRDAN108RP0002V01200001/A0017V01202122)

This section is applicable if it is shown on Your schedule.

We will pay the outstanding vehicle loan amount payable by You to financial institution in case of death OR permanent total disability of owner driver in direct connection with the insured vehicle whilst mounting and dismounting from or driving or travelling and caused by violent, accidental external and visible means provided insured vehicle is damaged by a covered peril mentioned in Section I of the policy. You will have to submit the amortization chart referred to in the loan agreement (or any amendments thereto) between the Bank/Financial Institution and You.

What is not Covered:

  1. We shall not pay any compensation in respect of death, injury/permanent total disability directly or indirectly wholly or in part arising or resulting from traceable to
    • Intentional self injury suicide or attempted suicide physical defect or infirmity or
    • An accident happening whilst such person is under the influence of intoxicating liquor or drugs.
    • If the vehicle is a total loss/constructive total loss or theft is reported.
    • For more than one covered incident during the Period of Insurance.
  2. If claim under Section I is not valid and not admissible.

  • This add on is available with 3 different options to choose for at the time of claim.
  • If insured Vehicle is damaged by the covered peril mentioned in section 1 (Own damage) of the policy, We will allow compensation in the form of –
    • Daily Allowance OR Courtesy/Hire Car OR Travel expenses

What is covered:

A. Daily Allowance

We will pay You Daily Allowance as mentioned in the schedule to enable You to meet the cost of hired transport to reduce Your inconvenience, if Your Vehicle is damaged by a covered peril mentioned in section 1 of the policy.

The allowance would be payable for a maximum period of <* > days for first <* > claims other than theft of entire vehicle/Constructive total loss/total loss claim during the Period of insurance. In case of theft of entire vehicle/ Constructive total loss/total loss claim, We will pay for maximum 15 days during the Period of insurance.

Your entitlement of Daily Allowance will start from the following calendar day of Your Vehicle reaching the garage for repair or the day of survey of vehicle, whichever is later and shall end on the day garage intimates You to take delivery of the vehicle.

The cover will be available for maximum number of days as mentioned in policy schedule for repair claim. The cover is available in option of 4 days, 6 days, 8 days & 10 days. In case of total loss/ theft of entire vehicle claims, cover limit is up to maximum of 15 days.

This cover allows daily allowance benefit for number of days cover selected by You or actual number of days required for the repair of the vehicle whichever is lower.

B. Courtesy Hire/Car:

We will arrange for the Courtesy/Hire car to reduce Your inconvenience if insured Vehicle is damaged by a covered peril mentioned in section 1 (Own damage) of the policy.

A Courtesy/Hire car is not intended to be an exact replacement of the insured vehicle in terms of its size, segment, type, value or status.

Courtesy/Hire car will be made available within 24 hours of the insured Vehicle reaching the garage or the time of intimation of claim to us, whichever is later excluding weekends/ national holidays, provided time required for repair of vehicle is greater than 24 hrs. If it is a claim for theft of entire vehicle/Constructive total loss/total loss. Company will pay for the Courtesy/Hire car for a maximum period of days as mentioned in policy schedule in case of repair claim and 15 days in case of theft of entire vehicle/total loss claim during the Period of insurance.

Courtesy/Hire car will be provided for <*> hrs or <*> Km per day whichever is less for first <* > claims other than theft of entire vehicle/ Constructive total loss/total loss claim during the Period of insurance. The terms and conditions of the Hire Car Company will apply. You will be given a copy of the Hire Car Company’s terms and conditions when the hire car is delivered to you.

Your entitlement of Courtesy/Hire car, in case of repair claim, will be start from the following calendar day of Your Vehicle reaching the garage for repair or the day of survey of vehicle, whichever is later and shall end on the day garage intimates You to take delivery of the vehicle irrespective of claim settlement is intimated.

Courtesy/Hire Car will be available in 3 options:

  1. 8 hrs or 80 kms per day, whichever is less
  2. 10 hrs or 100 kms per day, whichever is less

3. Travel Expense:

If You do not want to avail Daily Allowance or Courtesy/ Hire benefit then –

We will pay Your cost of travel expenses Rs <*> per day as per daily allowance cover (Predefined fixed) for the period determined as above. In case You opt for travel expenses, terms and conditions of the Company providing it will apply.

  1. What is not Covered:

The claim under Daily allowance Plus will not be payable if any or all of the following condition applies: (We will not provide You with a Courtesy/Hire car)

  1. If You are only claiming for windscreen or any other glass damage under section 1 (Own damage) of the policy.
  2. If Vehicle is not repaired at our Authorised Garage/Authorised workshop/Authorised service station.
  3. If claim under section 1 (Own damage) is not valid and admissible.
  4. If time taken for repair is in respect of damages not admissible under section 1 (Own damage) of the policy.
  5. Period for which vehicle is stuck for repair for non availability of any part and/or material at garage would be excluded for the purpose of computation of duration for the claim.

This cover is applicable if it is shown on Your Policy schedule.

Definitions:

  • Panel: It is the external body part of the vehicle which forms the outer shell of a vehicle like Bumpers, Fenders, Hood, Doors, Roof & Deck lid/Tailgate.

What is Covered:

We will pay you for the cost of repair to any one Panel of your vehicle provided that,

  • the accidental damage to the Panel has occurred during the policy period caused by perils specified under section 1 of the base policy but could not be reported as per base policy condition immediately after the damage to the Panel for any reason.
  • such earlier damage to the Panel is being reported later along with the subsequent Own damage claim under section I of the base policy which is admissible under the base policy.
  • such damage to the Panel can be repaired without replacement of any part.
  • Our liability is restricted to repair of one Panel only and upto the sum insured of this add on cover.

Special Condition:

  • Compulsory deductible and depreciation shall not be applied on claims under this add on cover.
  • Damages covered under this add-on shall be payable independent of Own Damage claim under the base Policy.
  • Only one claim will be payable under this add on cover during the policy period.

Definitions:

The terms defined below and at other junctures in the Policy Wording have the meanings ascribed to them wherever they appear in this Policy and where appropriate, references to the singular include references to the plural; references to the male includes other genders and references to any statutory enactment includes subsequent changes to the same.

  1. We, Us, Our, Ourselves means the TATA AIG General Insurance Co. Ltd.
  2. You, Your, Yourself – Means or refers to the person or persons described in the Schedule as the insured. In case schedule refers to an entity other than individual, then representative, of such an entity would be deemed as You, Your, Yourself.
  3. Constructive Total Loss – A vehicle will be considered to be a Constructive Total Loss (CTL), where the aggregate cost of retrieval and/or repair of the vehicle subject to terms and conditions of the policy exceed 75% of the Sum Insured.
  4. Courtesy/Hire car – A vehicle provided to the insured by the hire car company.
  5. Hire car Company – Company which is engaged in the business of letting out cars on hire and has provided vehicle to the insured as per their terms and conditions.
  6. Authorized workshop/garage/service station – A motor vehicle repair workshop/garage/service station authorized by us.
  7. Daily Allowance – Fixed amount to be paid for the purpose of meeting the cost of hired transport.
  8. Family – You, Your spouse, your children your parents and any other person residing with you without paying a commercial rent.
  9. Break-in – means to enter someone’s vehicle illegally by actual force or violence of which there shall be visible marks made at the place of such entry by electricity or chemicals as well as by tools or explosives, usually with the intent to steal or commit a violent act.
  10. Lost or stolen means having been inadvertently lost or having been stolen by a third party without your assistance, consent or co-operation.
  11. Period of insurance – The period of time stated in the schedule for which the policy is valid and operative.
  12. Policy Year means a period of twelve consecutive months beginning from the date of commencement of the Period of insurance and ending on the last day of such twelve-month period. For the purpose of subsequent years, Policy Year shall mean a period of twelve months commencing from the end of the previous Policy Year and lapsing on the last day of such twelve month period or the Policy Expiry date whichever is earlier
  13. Salvage – The damaged property or asset for which claim has been paid under the policy.

After investigating the grievance internally and subsequent closure, the Company will send our response within a period of 10 days from the date of receipt of the complaint by the Company or its office in Mumbai. Break-in Insurance

Break-in Insurance is a term used when there has been a considerable break between two insurance policies (i.e even for 1 day delay after due date with no grace period) . Such policies are also known as Break-in Policies.
In the case of such policies, there’s a chance that the insurer want to inspect the vehicle (mandatory) before renewing the insurance policy. This can increase the premium.
Thus, it is suggested to renew the policy before the expiry date to ensure no break in between policies. Also, if the gap is more than 90 days, the accumulated No Claim Bonus can reset to zero, leading to a higher premium while renewing the plan.

Cashless Garage

When an insurance company has a tie-up with a vehicle repair garage for cashless claim
settlement, that garage is termed as a Cashless Garage. They are also known as Partner
Garages and Network Garages. The most significant advantage of a Cashless Garage is
that the insurer directly settles car’s repair bill with the garage.

Claim Settlement Ratio (CSR)

It is the ratio between the number of claims settled and the number of claims received by
the insurer.
CSR = Claims settled in a year / Claims received in a year x 100
It is expressed in percentage and used to gauge the claim settlement rate of the insurer. A
higher CSR can mean higher chances of claim settlement. However, CSR should not be the
sole factor for selecting an insurer, as you must also consider overall services, policy
coverage, etc.

Endorsement:

Endorsement is a process by which you can make changes in your vehicle insurance policy
document. This is the document you receive after completing the online payment to buy
the policy. If you want to change a detail mentioned in the policy document, for example, a
spelling mistake, you can get it done via an Endorsement process.
In some cases, it is also allowed to make changes in the existing cover via this process. For
example, if you modify your car and want to insure the modified parts as well during the
policy period, you can do so using the Endorsement process.
